That may well be Microsoft's plan. Fortunately, Microsoft hasn't entirely completed their "probationary" period in the wake of the antitrust case brought by the Clinton Administration and that was deliberately subverted by the Bush Administration.

Now, a new administration under Obama, with a clear incentive to distance themselves from Bush and his policies, is in control of the Department of Justice, and they are obligated to weigh in later this year as to whether Microsoft is fulfilling its obligations under the law.

In addition, the EU has taken tentative (very tentative, but a start) steps toward reining in Microsoft's monopoly as in the decision with regard to SMB and Samba.

Couple all that to the recent meltdown of the world economy, and Microsoft may find they have bitten off more than they can chew if they try to kill GNU/Linux through their deal with Novell.
