“You may have noticed that in the teleconference on Tuesday, SCO
CEO Darl McBride made the claim that they have shown the code to
IBM in discovery and that IBM knows exactly what code is in
dispute. Specifically, he said this:

‘…by the way, we have shared the code in question there
with IBM under the litigation event. They know what we’re talking
about there.’

“There is room for skepticism. While it is impossible to rule
out that there may have been code shown privately that is not in
the public record yet, if Darl was referring to the list of files
it presented to IBM in discovery so far in the record, I think we
need to look at those lists of ‘infringing files’ more
carefully…”
