PR: Statement from SCO on the December 5, 2003 Court Hearing

On Friday, December 5, lawyers from SCO and IBM met with
Magistrate Judge Brooke Wells at a hearing to compel evidence.
SCO’s intention going into this hearing was to gain access to the
Sequent Dynix code and IBM’s AIX code. On December 4, the night
before the hearing, IBM provided SCO and its lawyers with the
Sequent Dynix code.

At the December 5 hearing, Judge Wells ordered SCO to provide
additional details involving the code that SCO had already provided
to IBM. As Judge Wells indicated at the hearing, both parties want
the other to produce specific code first. To get matters moving,
she asked SCO to go first. Judge Wells also ordered that on January
23rd, she will determine whether to compel IBM to provide the
additional requested code from the AIX operating system if it has
not already been produced by that date.
