Ars Technica: Is Code Free Speech?

“Is C code protected under the first amendment? Is a computer
program a form of speech? According to Peter D. Junger, a professor
at Case Western Reserve University, the answer to both of these
questions is yes.”

“Junger tried to post some encryption code on his class web site
and landed in federal court over it. He and his lawyers are arguing
that source code is basically a linguistic expression and should
therefore have full First Amendment protection as free speech. The
government, on the other hand, is arguing that source code is a
device just like circuitry, not a form of speech.”

“It’s going to be very interesting to see how this debate plays
itself out because both sides have very valid points.”
