USA Today: Microsoft breakup order is in the cards

“I really think Jackson has had it with Microsoft,” said
Robert Lande, professor of law at the University of Baltimore. “He
doesn’t believe a word they are saying; he’s not going to let them
babble on for months.”

“In addition to looking at remedies that were harsher than those
presented by the government, Jackson rebuffed Microsoft several
times during Wednesday’s hearing. He agreed with the government’s
argument that Microsoft forfeited its chance to cross-examine
experts who wrote declarations in favor of a breakup by failing to
do so in the weeks before the hearing.”

“Jackson’s aggressive timetable could itself be grounds for an
appeal. Even so, it’s unlikely such an appeal would make any
difference, Sterling said. The University of Baltimore’s Land said
an appeals court might agree Jackson should have heard more
witnesses. But an appeals court would be unlikely to vacate
Jackson’s order on those grounds alone, Sterling said. More likely,
the court would order Jackson to hear more testimony.”
