During their trademark action against MobiliX, “Lés Editions Albert
René” has accused MobiliX of “a new form of electronical
terror.” MobiliX has documented the case on its Web site in an
objective and polite manner. MobiliX’s lawyers, therefore, have
rejected the accusation of “electronical terror” as untrue and
polemical.

Also, the trademark-related argumentation has been rejected in
every case. The lawyers of “Lés Editions Albert René”
have especially tried to establish Obelix as a famous trademark,
which would get a special trademark protection. But this isn’t
true: the protection by a famous trademark needs a name, which is
famous as a product. But the public doesn’t consider the trademark
Obelix as a product, it thinks of a character from a comic. The
complete response (PDF, 9 pages, German) is available online.
