“Hot off the presses: Judge Dale Kimball has issued a 102-page
ruling on the numerous summary judgment motions in SCO v. Novell.
Here it is as text. Here is what matters most:

“[T]he court concludes that Novell is the owner of the UNIX and
UnixWare Copyrights.

“That’s Aaaaall, Folks! The court also ruled that ‘SCO is
obligated to recognize Novell’s waiver of SCO’s claims against IBM
and Sequent.’ That’s the ball game. There are a couple of loose
ends, but the big picture is, SCO lost. Oh, and it owes Novell a
lot of money from the Microsoft and Sun licenses….”

Novell Statement on Today’s SCO Ruling

This is the full, brief statement from Novell made last
night.

” From Joe LaSala, Novell senior vice president and general
counsel:

“‘In the spring of 2003, Novell set out to ensure that SCO’s
groundless claims would not interfere with the development of
Linux. Today’s court ruling vindicates the position Novell has
taken since the inception of the dispute with SCO, and it settles
the issue of who owns the copyrights of UNIX in Novell’s favor. The
court’s ruling has cut out the core of SCO;s case and, as a result,
eliminates SCO’s threat to the Linux community based upon
allegations of copyright infringement of UNIX. We are extremely
pleased with the outcome.'”
