NewsFactor: Can SCO Withstand the IBM, Red Hat Counter-Attack?

“Now that IBM and Red Hat have returned the SCO Group’s fire in
the Unix developer’s battle to collect royalties from Linux
distributors and users, some Linux experts are wondering if SCO has
bitten off more than it can chew. Specifically, they question
whether the Utah company has the resources to fight a legal war on
several fronts.

“‘Since [SCO] is not a very profitable company, it’s potentially
going to be more and more burdensome on them,’ George Weiss, a vice
president and research director of the server group at Gartner,
told NewsFactor.

“IBM, which was hit by a US$3 billion patent-infringement suit
by SCO this spring, countersued SCO on Thursday. IBM is alleging
that SCO’s suit–which claims Unix code owned by SCO was wrongly
included in Linux code in IBM products–is bogus. IBM reportedly
alleges that SCO is trying to profit by laying claim to open-source
code available to all under the General Public License.

“As well as defending that suit, SCO must deal with Red Hat’s
complaint on Monday, which seeks to stop SCO from claiming Red Hat
stepped on its intellectual property rights by distributing Linux
products containing Unix code…”
