“Just when you thought Microsoft (MSFT) ‘s lawyers couldn’t fit
any more clowns in the car, they work some final zingers into a
filing that was supposed to be a formality. Judge Jackson
asked that Wednesday’s filing address the “form,” not the
substance, of the government’s final breakup plan. But Microsoft
arguments such as “the relief requested by the government is
extreme and unjustified” might seem pretty substance-oriented to
some.”
“The Post-Intelligencer offered a concise, bulleted list of some
of Microsoft’s major suggestions. Among its semantic points,
Microsoft asked that the breakup be referred to as a “divestiture”
rather than a “reorganization” and noted that the government never
properly defined “Internet browser.” Microsoft also asked that “a
sentence about ensuring that rival products ‘interoperate
effectively’ with Microsoft products be trimmed to remove the word
‘effectively,'” according to the Wall Street Journal.”
